BidBrat.com and/or its’ affiliates (“BidBrat.com”, “us” or “we”) provide this website (“site”) and the services available throughout this site (“services) to you subject to the following conditions.  By visiting, registering or participating in this site, you accept these terms and conditions (“terms”).   We reserve the right, at our sole discretion, at any time to discontinue or terminate the site and services, modify the site and services. or modify these terms and conditions without any advance notice to you.   If any such changes are made by us, they will not be effective unless we haveprovided you with notice of such changes.  If changes are not acceptable to you, your only recourse is to stop using this site and all services and/or cancel your account with us.  By continuing to use or access this site, after we have notified you of the changes/revisions to terms, you agree to be bound by such terms.   

USER ELIGIBILTY:  By registering with us, you agree that you are a United States or Canadian resident, 18 years or older and are able to enter into binding contracts.  Canadian residents take fully responsibility for any duty charges that may be incurred from your own country.  Affiliates, vendors, contractors, and immediate family of BidBrat.com are prohibited from using the site and services offered on BidBrat.com. 

USE LICENSE:  By registering and using BidBrat.com, permission is granted to use the website for personal, non-commercial transitory use only.  This is the grant of a license, not a transfer of title, and under this license you agree not to do any of the following: 

1.  modify or copy any materials in any way whatsoever

2.  use the materials for any commercial purpose or for any public display 

3.  attempt to decompile or reverse engineer any software contained on website

4.  remove any copyright or other proprietary notations from the materials; or

5. collect or store personal data about other users without their express permission.

6.  transfer the materials to another person or “mirror” the materials on any other server

7.  upload any virus or computer code that may destroy or limit the functionality of the website

8.  Use any third party bidding software or other "bot" to assist in bidding or harvesting site data.  Collude or cooperate with other users to change the outcome of any auctions  

PURCHASING AND BUYING BID TOKENS: Bid Tokens must be purchased prior to bidding on BidBrat.com.  Bid Tokens are offered and purchased in bundles called "bidpacks". Prices are displayed on the website.  Payment can be made by credit or debit card through PayPal.  Payments must be in the name of the registered account holder. Payments made by third-parties for purchases will not be accepted.  Bid Tokens are valid for one year from the date of purchase.  After that date, bid tokens become null and void and can no longer be used.   

USING BID TOKENS: Once any Bid Token is used, it is deducted from your account and can not be used again.  Refunds will not be issued for free, used, expired or any promotional or won bid tokens in any auction.  See Refund Policy for more information. 

YOUR ACCOUNT:  You must create an account with us to use certain features and to post any content as described below.  You may register only one user account per user. During the registration process, you will choose a username,  BidBrat.com reserves the right to refuse registration, cancel an account or change a username if it is found by us to be illegal, offensive, racist, or infringing upon the rights of othersor does not meet these terms of service in any way.  At anytime, members of the same household may not participate in the same auction.  By registering with BidBrat.com you agree to be fully responsible for maintaining your account.  You are responsible for the confidentiality of your account and password information and for restricting access to your computer.  You agree to accept full responsibility for all activities that occur under your username, account and password. By registering with BidBrat.com you agree to receive correspondence from us electronically.  We will communicate with you in regard to shipments, any transactions and service issues.  We may also communicate with you for marketing and promotional purposes. You can unsubscribe from such marketing correspondence at any time. BidBrat.com reserves the right, at their sole discretion to disqualify you, terminateand close your account, cancel orders or refuse service, for any reason, including, but not limited to applicable law, a violation of the terms of this agreement or any reason whatsoever.  If your account is terminated by BidBrat.com for any reason, purchased, unused bid tokens will be refunded within 14 business days.  Promotional (free), used and won bid tokens will not be refunded.  

WINNING AUCTIONS/PURCHASING “BUY IT NOW” PRODUCTS: By participating on BidBrat.com, you agree that when you place bids and win an item, it is a contract to purchase that said item.  When an auction has ended, the successful bidder will be presented with a page that will confirm the win and payment can be made..  Winners will have 7 days  from the end of the auction date to make a payment.  After this 7 day period has lapsed, the winner of said auction will not be able to claim the item and the offer is revoked.  If a user wins an auction and does not pay for that auction, thier account is subject to closure and can be revoked immediately by BidBrat.com. The first time this happens, you will receive a warning, the second time, your account will be closed. and no refunds of any kind will be given to user. BidBrat.com will offer, at times, items for sale at a “Buy It Now” price.  Users that use the “Buy It Now” price option will need to purchase the product immediately.  You may win up to 15 auctions in a calendar month or in any part of a calendar month.

  IMPORTANT:  Be sure to read the "FAQ’s" and "How BidBrat.com Works" pages so that you know how each auction type works.

  RETURNS:  All auctions have different return policies.  Each auction will be clearly marked. The standard return policy, on allowable returns is 10 days after you the receive the item. Users are responsible for all shipping costs on returned items and items must be returned in unused and brand new condition.  Certain items are not eligible for returns.  Those items will be clearly marked on the auction page.   Requests for returns and any cancellations must be made in writing through our “Contact Us” page. If you are unable to return the item in unused and new condition, BidBrat.com has the right to accept the returned item and to reduce the amount of your refund equal to the damage on the item.  This amount will be determined solely by BidBrat.com.  Returning any item does not entitle the user to any refund of the bid tokens used to win our purchase the item.

SHIPPING COSTS:  All shipping costs will be clearly displayed for each item on BidBrat.com.   Any winner or purchaser will be responsible for the full shipping price as displayed.  Delivery is available within the 48 contiguous United States, Alaska, Hawaii and Canada.  Some restrictions or higher shipping costs may apply to Alaska, Hawaii and Canada.   These will be clearly outlined on the item.  Delivery times may vary.  Any stated delivery times should be considered guidelines and are not guarantees.  BidBrat.com shall be entitled to involved third parties to satisfy shipping obligations without being required to notify the buyer.  You are fully responsible for inspecting the item and reporting immediately any damages to the item to BidBrat.com. 

CONTENT POLICY:  Users of BidBrat.com may post photos, comments, videos, reviews, and other content so long as the content is not obscene, threatening, illegal, invasive, objectionable or injurious to third parties or to BidBrat.com.  Content may not include the following:  chain letters, spam, software viruses or malware, commercial solicitations, mass mailings, campaigning of any sort, or any type of spam.  Users may not use a false email address, impersonate any entity or person, or mislead as to the origin of any content.  Any content that you post or send to BidBrat.com, grants BidBrat.com a nonexclusive, royalty-free, irrevocable and fully sub licensable right to use, publish, translate, modify, distribute or display such content throughout the world in any media form.  You grant BidBrat.com the right to use the name that you submitted in connection with any and all submissions.   BidBrat.com does not endorse any users opinions, submissions, advice or claims of any type.    

SYSTEM TECHNOLOGY OUTAGES:  In some cases, system outages are completely beyond BidBrat.coms’ control.  No current technology today can guarantee 100% uptime.   System outages may interrupt user’s ability to register, view, and bid or make purchases on the website.  If this occurs, BidBrat.com will halt all auctions and bidding on any auctions until the issue is resolved.  Auctions that are halted will be clearly marked and BidBrat.com will make reasonable efforts to resume the auctions after issue is resolved.  In the event of a system wide outage that prevents you from bidding during a live auction, BidBrat.com will refund the Bid Tokens used in auctions that users were participating in at the time of the outage. 

THIRD PARTY WEBSITES:  BidBrat.com may contain links to other websites operated by third parties.  We assume no liability for the content of any external websites.  Linked websites are solely responsible for their own content and you should be aware and read their terms, conditions and privacy policies.   

STRATEGIES THAT BIDBRAT.COM MAY PROVIDE: As a courtesy, BidBrat.com may provide strategies, tips, ideas, and suggestions on bidding.  These are provided as a courtesy only to assist you.  BidBrat.com makes no warranties for accuracy or makes no guarantees to the user of such strategies.    Any strategies, tips, ideas, and suggestions by BidBrat.com or other users are not a guarantee of winning any auction.   If used, the user does so at their own risk. 

LIMIT OF LIABILITY:  In no event will BidBrat.com or any of its employees, directors, agents, or affiliates are liable to you or any third party for any incidental, special, consequential, or punitive damages, including but not limited to lost profit damages arising from your use of the services of BidBrat.com.  Even if BidBrat.com has been notified and advised of the possibility notwithstanding anything to the contrary contained herein, BidBrat.coms’ liability to you for any cause whatsoever and regardless of the form of action, will be at all times be limited to the amount paid by you to BidBrat.com for bid tokens in the 6 month period preceding the event that started the liability.   

WARRANTY DISCLAIMERS:  You agree that any item that you may win or purchase on BidBrat.com is sold with the manufacture’s limited warranty. You acknowledge and agree that the warranty period varies by manufacturer and product. For travel products you agree that you must comply with the owners or companies’ individual policies in regard to cancellations, expiration dates, house rules, and any other policy published on their websites.  Products and services available through BidBrat.com are provided on an “as-is” basis without warranties of any kind.   You understand and agree that there is no guarantee that you will be able to win items on which you have bid, and that every time you place a bid, such bid is deducted from your user account and can no longer be used, whether or not you win the said item. You also agree to indemnify, and hold BidBrat.com, it’s employees, officers, agents, directors and affiliates harmless from and against any claims, liabilities, damages, expenses, and losses, including without limitation, reasonable attorney’s fees and costs, arising out of or in any way connected with (a) your access to or use of the site and/or services, (b) your violation of these terms (c) any claim that any of your content caused damage to a third party  These terms constitute the entire agreement between the parties with respect to the use of the site and services.  If you do not agree to these terms - do not use the website.    Any Dispute relating to these terms will be governed by the laws of the United States and the laws of the state of Nevada, without regard to U.S. or Nevada choice of law rules, You and BidBrat.com agree and consent that jurisdiction, proper venue, and the most convenient forums for all claims, actions, and proceedings of any kind relating to BidBrat.com or the matters in these terms will be exclusively in courts located in the state of California.
